Mediation & Single Joint Expert
Appointment as Single Joint Expert or independent financial analysis to support mediated settlements.
Overview
Appointment as Single Joint Expert (SJE) in financial remedy proceedings, or provision of independent financial analysis to support mediated settlements. Our approach is neutral and constructive, focused on producing analysis both parties can rely on, whether in mediation, collaborative law, or consent-based proceedings.
When to instruct
Cases proceeding by consent, mediation, or collaborative law where an independent financial expert is needed by both parties.
Neutral Financial Analysis for Consent-Based Proceedings
Mediation, collaborative law, and private FDR require financial information both parties can trust. A jointly instructed expert, or Single Joint Expert (SJE), provides independent analysis that supports informed negotiation rather than adversarial litigation.
Our experts are experienced in dual instructions and understand the different dynamics of consent-based proceedings compared to contested financial remedy hearings.
Single Joint Expert Appointments
Under FPR Part 25, a Single Joint Expert may be appointed by agreement between the parties or by court direction. The expert's duty is to the court, and the report is relied upon by both sides unless successfully challenged. SJE appointments are common for business valuation, pension analysis, and tax issues in financial remedy proceedings.
- Joint letter of instruction agreed by both parties' solicitors
- Neutral analysis with methodology disclosed to both sides
- Report suitable for FDR, final hearing, or consent order
- Expert available for questions and joint expert discussions
Mediation and Collaborative Law
Where proceedings have not yet been issued, or parties are negotiating through mediation or collaborative law, an independent financial report can establish a shared factual baseline for asset values, income, and pension CETVs. This reduces disputes over figures and helps parties focus on outcome rather than methodology.
