Pensions in UK Divorce Proceedings

Pension assets are often the second largest asset after the family home in long marriages. In England and Wales, the court may make a pension sharing order, a pension attachment order, or offset pension value against other assets. The Pensions on Divorce etc. (Provision of Information) Regulations 2000 require pension schemes to provide a Cash Equivalent Transfer Value (CETV) on request.

Pension Sharing Orders

A pension sharing order transfers a percentage of one party's pension benefits to the other party as a credit within the same scheme or an external transfer. The expert report may model different percentage splits and explain the effect on retirement income for each party.

Where a pension attachment order (earmarking) is proposed, the expert can analyse the income stream implications. Attachment orders are less common since pension sharing was introduced but remain available in appropriate cases.

Scotland and Northern Ireland

Pension sharing operates under separate legislation in Scotland and Northern Ireland. In Scotland, pension rights are treated as matrimonial property under the Family Law (Scotland) Act 1985. In Northern Ireland, pension sharing orders are available under the Welfare Reform and Pensions (Northern Ireland) Order 2005.
